Terms of Service
1. Introduction
Welcome to MicroBuilder ("we", "us", or "our"). We connect businesses and entrepreneurs ("Clients") who need custom automations, internal tools, or micro-SaaS builds with experienced independent developers ("Builders").
By accessing or using our website or services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please discontinue use of the Service.
2. Eligibility
You must:
- Be at least 18 years old,
- Have legal authority to enter into binding contracts, and
- Provide accurate and current information when interacting with our forms or payment systems.
3. Description of Service
MicroBuilder provides:
- Tools for project scoping and instant estimates,
- Matching services between Clients and independent Builders, and
- Secure payment processing via trusted third parties such as Stripe.
We coordinate communication and delivery but do not act as an employer or legal representative of Builders.
4. Quotes, Payments & Refunds
1. Estimates
Price tiers and quotes displayed on the website or sent by email are initial estimates based on your description. Final pricing is confirmed after scope review.
2. Payments
Payments are processed securely via Stripe or another EU-compliant provider. We never store credit-card details ourselves.
3. Refund Policy
- Full refunds are available before work begins.
- Once development starts, partial refunds may be offered at our discretion depending on progress made.
- "Custom Build" projects may include a non-refundable deposit after scope confirmation.
- We always aim for client satisfaction and transparent communication.
4. Disputes
Please contact hello@microbuilder.dev before opening any dispute or chargeback — we'll work to resolve issues promptly.
5. Pricing and Scope
Scope of Work
All instant estimates and payments made through MicroBuilder cover the specific scope described in the initial project request. Any additional features, integrations, or changes requested after payment will require a revised estimate and separate payment before implementation.
Custom Projects
For projects categorized as Custom, a manual review is required. A builder will provide a detailed quote before payment is requested.
Complex Automations (n8n/Make)
Certain workflow automations may require custom scoping (e.g., multi-branch flows, multiple OAuth integrations, bidirectional sync, rate-limit handling, or advanced error policies). These requests are quoted manually before work begins. Instant tier prices apply only to standard automations as defined on the Pricing page.
6. Intellectual Property & Reuse Rights
1. Client Ownership
After full payment, the Client owns the specific software, code, designs, and deliverables produced for their project ("Deliverables"), excluding reusable components defined below.
2. Reusable Components
MicroBuilder and its Builders retain ownership of pre-existing libraries, templates, frameworks, and utilities used to build Deliverables. These may be reused or resold in future projects, provided no Client data, branding, or confidential information is included.
3. Derivative Use & Templates
MicroBuilder may reuse anonymised structures, layouts, or generic functionality patterns to improve internal tools or develop public templates and marketplace offerings. Client-specific data and branding are never reused.
4. Builder IP
Builders assign all rights in project deliverables to the Client upon completion and payment, while retaining ownership of non-client-specific reusable code.
5. License for Improvement
The Client grants MicroBuilder a non-exclusive, royalty-free licence to retain and reuse anonymised, non-identifying parts of Deliverables for testing and improvement purposes.
6. Confidentiality
All Client data, brand materials, and proprietary business logic remain confidential and will never be disclosed or resold.
7. Builder Relationship
1. Independent Contractors
Builders are independent professionals, not employees or agents of MicroBuilder.
2. Assignment of Rights
Builders assign Client-specific intellectual property rights to the Client upon completion, while retaining generic, reusable components as outlined in Section 5.
3. Project Oversight
MicroBuilder facilitates scope definition and quality checks but cannot guarantee individual Builder timelines or performance beyond agreed milestones.
4. No Employment Relationship
Nothing in these Terms establishes employment, partnership, or joint-venture status between MicroBuilder, Clients, or Builders.
8. Acceptable Use
Clients agree not to:
- Use the Service for illegal or fraudulent purposes,
- Disrupt or interfere with website functionality,
- Attempt unauthorised access to data or systems, or
- Post or share harmful, infringing, or obscene materials.
MicroBuilder may suspend access for any misuse or violation of these Terms.
9. Confidentiality
MicroBuilder and Builders treat all Client materials and information as confidential. Clients agree not to share internal details of MicroBuilder's processes or builder network without permission.
10. Disclaimer of Warranties
The Service and Deliverables are provided "as is" and "as available." MicroBuilder provides no guarantees regarding:
- Fitness for a particular purpose,
- Freedom from defects, bugs, or interruptions, or
- Suitability for commercial use.
We will make reasonable efforts to ensure quality and satisfaction.
11. Limitation of Liability
To the extent permitted by Swedish law:
- MicroBuilder shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
- Our total aggregate liability for any claim shall not exceed the total fees paid by the Client for the project concerned.
Nothing in these Terms limits liability for gross negligence or wilful misconduct.
12. Indemnification
You agree to indemnify and hold harmless MicroBuilder, its affiliates, employees, and Builders from any claims, damages, or losses (including reasonable legal fees) resulting from:
- Your breach of these Terms, or
- Your misuse of the Service or Deliverables.
13. Termination
Either party may terminate an ongoing project by written notice. Refunds will follow the policy in Section 4. MicroBuilder may suspend or terminate Service access for any misuse, non-payment, or violation of these Terms.
14. Project Feasibility and Limitations
1. Technical Feasibility
MicroBuilder reserves the right to decline or cancel any project request that is determined to be technically infeasible, unsafe, or outside the scope of our platform or builder network.
2. Non-Binding Estimates
All automatic estimates or tier suggestions provided on our website are for initial guidance only. A project is not confirmed until it has been reviewed and accepted by a Builder.
3. Alternative Proposals
In cases where a requested solution cannot be built as described, MicroBuilder may suggest an alternative approach or simplified version. Clients are not obligated to proceed with the revised scope.
4. Refunds for Infeasible Projects
If payment has been made and the project is later deemed infeasible, MicroBuilder will provide a full refund or credit, unless the Client opts to proceed with a re-scoped solution.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gothenburg, Sweden.
16. Modifications
We may update these Terms from time to time. The revised version will be posted on this page with a new Effective Date. Continued use of the Service indicates acceptance of the updated Terms.
